General Terms And Conditions

FundamenTELLE Health and its representative are not medical doctors, medical professionals, or mental health professionals, and do not give medical advice. Treatment is not a substitute for professional medical treatment or advice and does not purport to provide medical information or diagnoses. All the information shared by the fundamenTELLE Health Representative is his/her opinion and it should not be used in place of advice of my physician or medical professionals. It does not take into account any pre-existing medical conditions, interactions with any medication or medical treatment being undertaken by an individual advised or otherwise. It is recommended that clients seek professional medical advice before seeking treatment from fundamenTELLE Health and its representatives, and before implementing any recommendations given. 

The fundamenTELLE Health Representative does not represent or guarantee that participants will experience any result or outcome by implementing any recommendation or advice provided. Britelle Humfrey, fundamenTELLE Health and their offices, employees, agents, contractors, consultants and representatives assume no responsibility or liability for any consequences, including any injury, death, damage, loss, delay, cost, expenses or inconvenience arising directly or indirectly from advice, opinions, or any action taken by you as a result of the information provided to you.

Individual Session Booking Terms And Conditions

fundamenTELLE Health maintains a strict 24 hour cancellation policy which applies to all 1:1 consults and bookings. Bookings must be cancelled or rescheduled 24 hours prior to the session, or all payments are considered forfeited. Any reschedules must be used within 6 months of initial purchase. All gift vouchers, promotional consults or pre-bought consults must be used within 6 months of original purchase. 

Event, Retreat And Group Session Booking Terms And Conditions

  • Created by Sumana Chamrunworakiatfrom the Noun Project Payment plans can be made available and will incur a small administration fee.
  • Created by Sumana Chamrunworakiatfrom the Noun Project It is each individuals responsibility to manage any food allergies or sensitivities they may have where events are catered.
  • Created by Sumana Chamrunworakiatfrom the Noun Project fundamenTELLE Health shall in no event be held liable for any loss or other damages including but not limited to special, incidental, consequential, or any other damages.

Refund Policy

If a client decides to cancel an event after payment has been made, transferring the clients space to another participant is allowed based on the following:

  • Created by Sumana Chamrunworakiatfrom the Noun Project if current participant sources the new participant, $50 admin fee applies
  • Created by Sumana Chamrunworakiatfrom the Noun Project if fundamenTELLE Health is asked to find the new participant, 10% admin fee applies
  • Created by Sumana Chamrunworakiatfrom the Noun Project if no replacement is found, full refund (excluding above fees) will be provided 6 weeks prior to the event, 50% refund will be provided 30 days prior to the event, no refund will be provided within 2 weeks of the event.

In the event other similar events are scheduled, a transfer can be offered, following the above replacement policy + any price difference.
No refund is given under unexpected circumstances that are out of fundamenTELLE Health's control. fundamenTELLE Health is not liable under the circumstances of natural disaster, war, pandemic, failure by the venue or other situation that is out of fundamenTELLE Health's control. fundamenTELLE Health will do their best to sort alternative arrangements depending on the scale of the situation.

Cancellation Policy

All information included in publicity is correct at the time of going to press, but may be subject to change. Whilst fundamenTELLE Health does not anticipate changes to the advertised event and retreat dates, we may for any reason deem it necessary to change the program dates, audience capacity, venue, speaker or hours without prior notice.
fundamenTELLE Health reserves the right to reschedule or cancel any event if we feel it is necessary and in the best interest for both parties (You, the attendee, and fundamenTELLE Health), this includes instances of Force Majeure.
We will notify you in writing no later than 30 days before the event is due to begin, except for Force Majeure, unusual or unforeseen circumstances outside fundamenTELLE Health's control. In which case, we will transfer your enrolment to another available date, or offer another program of equal value, to attend within 12 months. Monies paid will not be refundable and fundamenTELLE Health will not be held liable for any compensation.

Live Event Indemnity Agreement

This is an Indemnity Agreement between You (the Client) and fundamenTELLE Health (ABN: 73660106785) of Canning Vale, WA, Australia 6155.
By attending the fundamenTELLE Essentials Detox Retreat, fundamenTELLE Breath and any other live and in -person event, I acknowledge and agree:

  • Created by Sumana Chamrunworakiatfrom the Noun Project It is your responsibility to arrive on time at the start of each session of the program. Missed content is not available after the event.
  • Created by Sumana Chamrunworakiatfrom the Noun Project Recording of any part of the program is strictly prohibited. Devices such as phones, voice recorders, cameras and video cameras must not be used during any program without the prior express written permission of fundamenTELLE Health.
  • Created by Sumana Chamrunworakiatfrom the Noun Project fundamenTELLE Health retains all intellectual property rights comprised in the patent, copyright, design, trade mark, eligible layout or similar right whether at common law or conferred by statute, and all rights to apply for registration under a statute in respect of those or like rights, including but not limited to goodwill, and rights to protect confidential information, trade secrets and know how, throughout the world for the full period of the rights and all renewals and extensions, in respect of any Program Content. Program Content includes all written work, artistic work, spoken word, audio recordings, video recording, live performances and presentations, and guest presentations. Program content must not be copied, reproduced or sold in any way without the express written permission of fundamenTELLE Health. Should you wish to use direct quotes from program content, whether for personal or commercial use, you agree to obtain written permission from fundamenTELLE Health before doing so.
  • Created by Sumana Chamrunworakiatfrom the Noun Project The program may be recorded or documented by fundamenTELLE Health or its authorised representatives for training and promotional purposes. You hereby authorise fundamenTELLE Health or its representatives to take photographs and audio/visual recordings of your participating in the program. You hereby grant to fundamenTELLE Health the exclusive rights to publish, broadcast, reproduce, transmit and communicate any recordings or photographs to the public, including as part of promotional or commercial materials. Please provide in writing express request to fundamenTELLE Health to NOT have your photos or similar utilised in this way.

Exclusions

Depending on the event being attended, expenses that MAY be excluded, depending on the event you are attending, include but are not limited to:

Travel And Health Insurance:

We recommend purchasing adequate comprehensive travel insurance for any event where travel and/or accommodation is required to attend a fundamenTELLE Health event.
It is the Attendee’s responsibility to ensure their travel insurance covers all expenses that may arise during travel including, but not limited to:

  • Created by Sumana Chamrunworakiatfrom the Noun Project Illness/personal injury
  • Created by Sumana Chamrunworakiatfrom the Noun Project Loss or damage
  • Created by Sumana Chamrunworakiatfrom the Noun Project Medical treatment
  • Created by Sumana Chamrunworakiatfrom the Noun Project Repatriation
  • Created by Sumana Chamrunworakiatfrom the Noun Project Force Majeure
  • Created by Sumana Chamrunworakiatfrom the Noun Project Other unforeseen circumstances

The participant should also provide a copy of their travel insurance to their emergency contact prior to departure.

Breathwork Disclaimer And Contraindications

When participating in breathwork exercises, clients understand they are doing so at their own risk and are responsible for monitoring their own health and ability levels. Clients are responsible for stopping the process at any time they feel unusual discomfort.
Clients agree and understand that it is advised to not partake in any alcohol or recreational drugs the day prior to any breathwork session.
Clients agree and understand that the following medical conditions mean they need to approach breathwork with caution and, should they choose to participate, need to do so in a slower pace than most people. Clients with a history of the below contraindications should consult their healthcare professional before participating in this work. This is the client’s responsibility.

  • Created by Sumana Chamrunworakiatfrom the Noun Project Pregnant women and women on day 1-3 of menstruation are advised to not participate in any deep belly breathing activities or breath holds.

Clients with infectious or communicable diseases such as Corona Virus or Flu like symptoms are asked to avoid attending group events due to the nature of group breathing and exercise.
  • Created by Sumana Chamrunworakiatfrom the Noun Project Breathwork will incorporate body work and physical touch from the facilitators in order to support energy flow through the body. Clients are responsible for advising the facilitators if this is something they are sensitive too.

Clients understand that conscious connected breathwork gives an opportunity to release any chronic muscular tension and free flow of energy in the body.

The fundamenTELLE Health Representative and their officers, employees, agents, contractors, consultants and representatives assume no responsibility or liability for any consequences, including any injury, death, damage, loss, delay, cost, expense, or inconvenience arising directly or indirectly from advice, opinions, or any action or inaction taken by clients as a result of the information provided to them or by participation in the session.

Downloadable Products

All downloadable digital products, either for free or paid, are for single-use print only by the original purchaser. They may not be shared, reproduced, or resold in any form. All content, designs, and images remain the intellectual property of fundamenTELLE Health Pty Ltd and are protected under copyright law.

Affiliate Program & Commissions Terms And Conditions

By participating in the fundamenTELLE Health Affiliate and /or Commissions Program, affiliates agree to:

  • Created by Sumana Chamrunworakiatfrom the Noun Project Payments will be made at the start of each month once a minimum of $50 has been earnt.
  • Created by Sumana Chamrunworakiatfrom the Noun Project Payments will be made via direct transfer into an Australian account or via PayPal for overseas affiliates.

  • Created by Sumana Chamrunworakiatfrom the Noun Project Retreat affiliate payment is 15%. However, if the client has made use of a discount rate, commission will be given in the gap figure only. For example, if the client has a 10% discount, commission will be 5% (a total of 15%).
